Over the last decade, Estepona has transformed from a charming, flower-filled coastal town into one of the most prestigious real estate markets in southern Spain.

The scale of this growth is reflected in the official data. According to the 2025 INE (Censo Anual de Población), Estepona’s population has climbed to 79,621 inhabitants, surpassing the local municipal register (padrón) which previously hovered around 72,000. This is a vibrant, cosmopolitan community where between 25% and 30% of registered residents are foreign nationals representing around 120 different countries. British expats remain the largest international group, with approximately 4,615 registered residents, followed by significant communities from Morocco, Russia (around 942 residents), Germany (around 835), the Netherlands (around 586), and Argentina, alongside a rapidly growing contingent of Scandinavian and Belgian homeowners.

Unlike denser urban centers, Estepona has a high concentration of detached villas with private gardens and plots. This drives a specific demand for property services: the installation and upkeep of pergolas, outdoor kitchens, glass terrace enclosures (cortinas de cristal), artificial turf, and intensive pool and garden maintenance. Meanwhile, beachfront developments like Costalita, Bahía Dorada, and Playa del Sol-Villacana present a different set of priorities, where community living rules and coastal weather dominate management decisions.

Navigating Local Regulations: Town Hall Permits and the Ley de Costas

When undertaking property improvements in Estepona, owners must navigate three distinct layers of regulation: the municipal town hall (Ilmo. Ayuntamiento de la Villa de Estepona), national coastal laws, and community rules.

1. Municipal Licenses (Obra Mayor vs. Obra Menor)

The Ayuntamiento de Estepona operates under a regulatory ordinance (Ordenanza Municipal Reguladora de Licencias) that clearly distinguishes between major works (obra mayor) and minor works (obra menor).

  • Obra Mayor: Required for complex projects that alter the building's volume, structural integrity, exterior composition, or change its designated use. This requires a formal project signed by an architect and can take several months to approve.
  • Obra Menor (Simplified Procedure): For simple technical works on urban land that do not affect the structure or increase volume, Estepona offers a fast-track system. By submitting a declaración responsable (responsible declaration) or comunicación previa along with the required municipal fees, work can legally begin just 15 days after submission, provided there are no official objections from the town hall.
  • Tolds, Pergolas, and Enclosures: Simple pergolas and awnings are generally treated as minor works. However, if you plan to install glass curtains or permanent terrace enclosures that alter the facade or effectively increase the enclosed volume of the property, the town hall may classify this as obra mayor.

2. The Ley de Costas (Spanish Coastal Law)

If your property is located on the frontline of the beach—such as in Costalita, Bahía Dorada, or along the coastal strip of Saladillo-Benamara—it is subject to the national Ley de Costas. These areas are affected by protection easements (servidumbre de protección), which typically extend 100 meters inland (reducible to 20 meters in consolidated urban land) and transit easements (servidumbre de tránsito) of 6 meters. This law strictly limits the construction of permanent, fixed structures close to the maritime-terrestrial public domain. Any significant outdoor remodeling in these zones requires authorization from the regional delegation of the coastal authority.

3. Community of Owners (Comunidad de Propietarios)

Before applying for any municipal license for outdoor works—such as installing glass curtains, changing awnings, or adding pergolas—you must consult your community’s statutes. In Spain, the Ley de Propiedad Horizontal dictates that any modification affecting the common aesthetic of the building or urbanization requires formal approval from the community of owners.


Holiday Rental Management and VFT Licensing in Estepona

The short-term holiday rental market in Estepona is highly lucrative, especially in premium areas like Atalaya, Benavista, Bel-Air, and El Presidente. However, operating legally is paramount.

To rent your property to tourists, you must obtain a tourist license (VFT - Vivienda con Fines Turísticos) from the Registro de Turismo de Andalucía.

  • Community Bans: Under current Spanish law, communities of owners can limit or ban holiday rentals within their complexes if a three-fifths majority votes to do so. Before purchasing or listing a property, we always verify the community statutes.
