The Reality of Marbella Planning Laws and Building Permits
If you plan to renovate your Marbella home, understanding the local planning landscape is critical. Marbella’s urban planning has a complex history: the 2010 PGOU (General Plan) was annulled by the Spanish Supreme Court in a series of rulings starting on 27 October 2015, which instantly restored the old 1986 PGOU as the governing plan. While a new PGOM (Plan General de Ordenación Municipal) received a favourable report from the Junta de Andalucía in February 2026 and awaits final plenary approval, the planning status of many plots remains legally uncertain, affecting an estimated 18,000 properties across the municipality.
Before undertaking any works, we must verify your property's status against the 1986 PGOU and check for any protected-zone overlays, which are common in areas like Sierra Blanca or Las Chapas. Furthermore, if your property is located near the beach in San Pedro de Alcántara or Elviria, works may fall under the Ley de Costas (Coastal Law), which imposes a strict "servidumbre de protección" (protection easement) setback of between 20 and 100 metres from the public maritime-terrestrial domain.
When it comes to securing permits from the Ayuntamiento de Marbella, do not make the mistake of assuming minor aesthetic upgrades are simple. Marbella municipal ordinances explicitly exclude terrace glazing or enclosures (acristalamiento/glass curtains) and any volume expansion from the "declaración responsable" (the fast-track notification process). These modifications require a full municipal licence for major works (obra mayor), not a minor works permit (obra menor).
Additionally, while small pergolas of approximately 5 square metres or less often do not require a formal licence, Marbella has issued a specific interpretive criterion regarding setback and separation distances from property boundaries that must be strictly respected.
Finally, if your property is part of a community of owners (comunidad de propietarios), the Ley de Propiedad Horizontal dictates that any change affecting common elements—including the building's façade, structural elements, railings, or even awnings visible from the street—requires formal community approval, typically requiring a three-fifths qualified majority vote.
